Terms of Service

01Acceptance of Terms

By downloading, installing, or using the Intuitum application, or by accessing the intuitum.app website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.

Your use of the Service constitutes acceptance of these Terms and our Privacy Policy, which is incorporated into these Terms by reference.

02Definitions

• •“Service” — the Intuitum mobile application (iOS and Android), the intuitum.app website, and all related APIs, features, and content.
• •“User” or “you” — any individual who accesses or uses the Service.
• •“Content” — all text, images, data, and other materials available through the Service, including AI-generated interpretations and user-submitted materials.
• •“User Content” — any content you submit to the Service, including questions, text input, and uploaded card images.
• •“Subscription” — a paid plan (Plus or Unlimited) that provides additional features and usage beyond the free tier.
• •“Device” — the mobile phone or tablet on which you install and use the Intuitum application.

03The Service

Intuitum is a tarot reading application that allows you to:

• •Draw cards from a 78-card tarot deck using various spread layouts
• •Receive AI-powered interpretations of your tarot readings
• •Scan physical tarot cards with your device camera for digital recognition
• •Receive AI-guided spread recommendations based on your questions
• •View your reading history and past interpretations

Device-based access

Intuitum does not require account registration. The Service identifies your device using a hashed device fingerprint. Your access, reading history, and subscription status are linked to your device. If you switch to a new device, your history and subscription may need to be transferred or restored through the applicable app store.

Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under the age of legal majority in your jurisdiction, you must have permission from a parent or legal guardian to use the Service.

Service availability

We strive to keep the Service available, but we do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

04Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• •Attempt to bypass device attestation, rate limits, or security measures
• •Use the Service through automated scripts, bots, or scrapers
• •Reverse-engineer, decompile, or disassemble any part of the Service
• •Impersonate another person or device, or misrepresent your identity
• •Upload malicious, harmful, or inappropriate content through the card scanning feature
• •Use the Service to harass, abuse, or harm others
• •Interfere with or disrupt the integrity or performance of the Service
• •Attempt to gain unauthorised access to the Service, its servers, or connected systems
• •Use the Service in any manner that violates applicable laws or regulations
• •Resell, redistribute, or sublicence access to the Service

We reserve the right to suspend or block your device from accessing the Service if we determine, in our sole discretion, that you have violated these Terms or are engaging in abusive behaviour.

05Intellectual Property

The Service, including its design, code, visual elements, tarot card artwork, animations, text, and all other content created by us, is owned by Intuitum and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service on your personal device for personal, non-commercial purposes, subject to these Terms.

You may not copy, modify, distribute, sell, or create derivative works based on the Service or its content without our prior written consent. The Intuitum name, logo, and all related marks are our trademarks. You may not use them without our permission.

06User Content & License

When you use the Service, you may submit content including:

• •Questions and text describing your situation for readings or spread guidance
• •Photographs of tarot cards uploaded for scanning and recognition
• •Feedback and ratings on interpretations and scans

You retain ownership of the User Content you submit. By submitting User Content, you grant us a limited, non-exclusive, worldwide, royalty-free licence to use, process, store, and transmit your User Content solely for the purpose of providing and improving the Service. This includes sending your content to third-party AI providers for interpretation and analysis, as described in our Privacy Policy.

You are solely responsible for your User Content. You represent and warrant that you have all necessary rights to submit it and that it does not infringe any third-party rights or violate any applicable laws.

07AI-Generated Content

The Service uses artificial intelligence to generate tarot interpretations, card analyses, and spread recommendations. You acknowledge and agree that:

• •For entertainment only — all AI-generated interpretations are provided for entertainment and personal reflection purposes only. They do not constitute professional advice of any kind, including but not limited to medical, psychological, financial, or legal advice.
• •No guarantees — AI-generated content may be inaccurate, incomplete, or inconsistent. We make no representations about the accuracy, reliability, or suitability of any interpretation.
• •Not a substitute for professional help — you should not rely on the Service as a substitute for professional advice. If you are experiencing a medical, mental health, or other emergency, contact a qualified professional immediately.
• •Variability — the same cards and spread may produce different interpretations at different times. This is inherent to AI-generated content and does not indicate an error.
• •Third-party AI — interpretations are generated using third-party AI services (such as OpenAI and OpenRouter). Your input data is processed by these services in accordance with their respective terms and our Privacy Policy.

08Subscriptions & Payments

Free tier

The Service offers a free tier with limited usage. The specific limits (e.g., number of readings, scans, or guidance requests per day) may be adjusted at our discretion.

Paid subscriptions

Intuitum offers two paid subscription tiers — Plus and Unlimited — available as monthly or annual plans. Subscriptions are purchased through the Apple App Store (iOS) or Google Play Store (Android) and are subject to the respective store’s terms and conditions.

Billing and renewal

• •Subscriptions are billed in advance on a recurring basis (monthly or annually) through the applicable app store
• •Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period
• •Your app store account will be charged for renewal within 24 hours prior to the end of the current period
• •You can manage and cancel your subscription through your device’s app store settings

Refunds

All purchases are processed by Apple or Google. Refund requests must be submitted to the respective app store in accordance with their refund policies. We do not directly process payments or issue refunds.

Price changes

We may change subscription prices from time to time. Price changes will take effect at the start of the next billing cycle following notice. Your continued use of the Service after a price change constitutes acceptance of the new price.

09Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• •Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• •Warranties that the Service will be uninterrupted, secure, error-free, or free of harmful components
• •Warranties regarding the accuracy, reliability, or completeness of any AI-generated content, card scanning results, or spread recommendations
• •Warranties regarding the compatibility of the Service with your device or operating system

Tarot readings and AI-generated interpretations are provided for entertainment and personal reflection purposes only. We do not warrant that any interpretation will be meaningful, accurate, or useful to you. You use the Service entirely at your own discretion and risk.

10Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INTUITUM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• •Your access to, use of, or inability to use the Service
• •Any conduct or content of any third party on the Service, including AI-generated interpretations
• •Any content obtained from the Service, including reliance on AI-generated readings
• •Unauthorised access to or alteration of your data or transmissions
• •Any decisions or actions you take based on content provided by the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY EUROS (EUR 50), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

11Indemnification

You agree to indemnify, defend, and hold harmless Intuitum and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

• •Your use of the Service or violation of these Terms
• •Your User Content or any content you submit through the Service
• •Your violation of any applicable law, regulation, or third-party right
• •Any action taken based on AI-generated content provided by the Service

12Termination

By you

You may stop using the Service at any time by uninstalling the application from your device. If you have an active subscription, you must cancel it through your app store settings before uninstalling to avoid further charges.

By us

We may suspend or terminate your access to the Service immediately, without prior notice, if we reasonably believe that you have violated these Terms, engaged in fraudulent or abusive behaviour, or if required by law. We may also block your device from accessing the Service.

Effect of termination

• •Your right to use the Service ceases immediately upon termination
• •Sections that by their nature should survive termination will remain in effect, including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, and Governing Law
• •You may request deletion of your data in accordance with our Privacy Policy by contacting us at privacy@intuitum.app
• •We are not obligated to retain or provide access to your reading history or any other data after termination

13Dispute Resolution

We encourage you to contact us first at hello@intuitum.app to resolve any dispute informally. We will endeavour to resolve your concern within 30 days.

If we are unable to resolve the dispute informally, you agree that any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law, or in a court of competent jurisdiction as set out in the Governing Law section below.

If you are a consumer in the European Union, you retain the right to bring proceedings before the courts of the member state in which you are domiciled. You may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14Modifications to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• •Update the “Last updated” date at the top of this page
• •Notify you through the app or by other reasonable means
• •Provide at least 30 days’ notice before material changes take effect

Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you should stop using the Service before the changes take effect.

15Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any legal proceedings arising out of or relating to these Terms shall be brought exclusively in the competent courts of the Netherlands, unless mandatory consumer protection laws in your jurisdiction provide otherwise.

If you are a consumer in the European Union, you are entitled to the protection of mandatory provisions of the law of the country in which you reside, and nothing in these Terms affects your rights as a consumer under such mandatory provisions.

16General Provisions

Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Intuitum regarding the use of the Service, and supersede all prior agreements, representations, and understandings.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
